Common Sense

In the concept of Harmony, there is to be found balance and wisdom. When we consider the proper function of law, there is both "The Letter of the Law" and "The Spirit of the Law". This is why there is supposed to be balance between Judge and Jury. The Judge should impartially mediate "Between the Pillars", and the Jury should be one that is fully informed.

In Due Process of Law, there is both Procedural and Substantive. Procedural deals with the process of each case, while Substantive applies to what rights if any, are harmed by the law, ordinance or statute in question.

Victimless crime should be dealt with in a manner that does not flood the "Prison System". There are hundreds of thousands of "Non-Violent Offenders" in our jails which have led to overcrowding, which have led to numerous early releases of "Violent" prisoners that should not be subject to early release due to overcrowding. Until we deal with the Systemic Problems, these event will continue to happen.

In the matter of Hierarchical Governance, there are indeed Laws that are Superior to others. We have been made a nation of dependents and Imbalanced Thinkers. The results of this approach has led to a Bi-Polar Society that defines things in terms of what is "Left" and "Right".
